The following terms and conditions (the ‘Terms’) apply to each application for, and all participation in, DANZAAR International Dance Auditions Festival organised by e-performa By attending the Festival and By buying the Festival Workshops Package or any individual workshop or class, You agree to these Terms.

In these conditions:

• ‘We, Organiser, Us’ e-performa 
• ‘Festival, DANZAAR Festival’ is DANZAAR International Dance Auditions Festival for which you wish to participate as a dancer.
• ‘You, Your, Dancer’ means the dancers participating in any of the workshops and/or auditions at the Festival’s next edition in March 2020.
• ‘Venue’ the place where the Festival will take place.
• ‘Festival Workshop Package’ is the entrance fee charged to each dancer, student, etc. that will attend the workshops in the Festival.
• ‘Studio, Dance Studio’ dance studios where dance auditions will take place.

 

Age Limit

By buying the Festival Workshops Package or attending any audition, workshop or class You confirm that by the 1st of March 2020 You are 18 year old or older.

Loss or Damage Suffered by You

Nothing in these Terms shall exclude or restrict the liability of either party to the other for death or personal injury resulting from negligence or for fraudulent misrepresentation or in any other circumstances where liability may not be limited under any applicable law.  Subject to the immediately preceding sentence:

• the Organiser shall have no liability for the damage, theft or loss of the Dancer’s property that occurs at the DANZAAR Festival. The Dancer shall participate in the Festival at its own risk and take out all appropriate insurances;
• neither the owner of the Venue nor the Organiser accepts any liability for any accident, damage or injuries suffered in any way in connection with the Festival by You, Your employees, invitees or any other person whatsoever.

Loss or Damage Caused by You

You shall indemnify the Organiser against all actions, claims, suits, costs, expenses or demands (whether in respect of damage to property, personal injury or otherwise and including all legal costs and other expenses suffered or incurred by the Organiser) which any person may bring or claim arising in relation to the Festival caused by Your breach of these Terms or any other acts or omissions of You, Your employees, Representatives or invitees.

Accommodation, Travel and Visas

You acknowledge and agree that the Organiser does not pay accommodation, subsistence, visas, insurance, international or domestic travel costs or other ancillary costs arising out of participation in the Festival.

Use of Venue, Dance Studios and Conduct at the Festival

• You shall not use the Venue for any illegal or immoral purpose and the Organiser reserves the right to remove all material that in its sole opinion may be considered offensive or obscene. 
• You shall not act in any way which may be derogatory or detrimental to the reputation, image and/or goodwill of the Organiser.
• All goods and property brought into the Venue are brought in at the owner’s risk.
• You are required to occupy Your Studio from the time notified to You by the Organiser.  
• The Organiser reserves the right to eject from the Venue any Dancer deemed to be acting inappropriately during the Festival.
• You are allowed to bring only water to the Studios. Any kind of food are not allowed.
• You and only You will have access to the Dance Studios. Neither friends or family members is allowed.
• You are not allowed to access the Dance Studios with Your shoes ON, walking with your shoes in the Studios is prohibited.

Intellectual Property Rights

You hereby grant to the Organiser a worldwide, non-exclusive, right to use any photograph, video and video frames taken by the Organiser, and were You may appear during Your participation in the Festival, for promotional, video and commercial use in connection with Your involvement with the Festival (including, without limitation in any promotional materials prepared by or on behalf of the Organiser for the Festival).

Participation Cancelled by You

There are circumstances where political tension and local incidents will raise a safety threat but not be sufficient to cancel the Festival. In such circumstances, Dancers may feel unwilling to visit a country and therefore decide to withdraw from the Festival. 

• In such circumstances, the Organiser is obliged to reimburse 90% of the Festival Workshops Package or any Workshops or classes minus any taxes and payment’s processing fee.

For circumstances that You can’t take part in DANZAAR Festival and notify the Organiser within 14 days from your purchase’s date (14-day cooling off period),  

• the Organiser is obliged to reimburse 90% of the Festival Workshops Package or any Workshops or classes minus any taxes and payment’s processing fee.

For circumstances that You can’t take part in DANZAAR Festival and notify the Organiser after 14-day of your purchase’s date and before the 29 of February 2020,  

• the Organiser is obliged to reimburse 50% of the Festival Workshops Package or any Workshops or classes minus any taxes and payment’s processing fee.

Refund

You acknowledge and agree that the Organiser will not refund the Festival Workshops Package or any Workshops or classes that you have bought if You:

• do not notify the Organiser Your cancellation before the 1st of March 2020. From 1st of March 2020 the Organiser will not issue a Refund even if the purchase is still in the 14-day cooling off period;
• do not attend any auditions, workshops or classes during the Festival’s days.

Refund for Workshop or Audition canceled due to Force Majeure

You acknowledge and agree that due to the special price of our Festival Workshops Package, the Organiser will not totally or partially refund the Festival Workshops Package if a workshop in the package is canceled.
If a workshop is canceled due to Force Majeure, the Organiser will issue a refund only to those that bought the workshop individually and a full price.

Festival Cancelled Due to Force Majeure

Neither party shall be in breach of these Terms if it is prevented from or delayed in performing its obligations under these Terms by acts, events, omissions or accidents beyond its reasonable control (‘Force Majeure’).

If the country or location of the Festival becomes unsafe due to an event of Force Majeure, including but not limited to war, earthquake, typhoon, adverse weather, strike, fires, floods, terrorism, pandemics, acts of god and any natural disaster, the Organiser reserves the right to cancel DANZAAR Festival with immediate effect.  

In such circumstances, the Organiser is obliged to repay You the amount of the Festival Workshops Package minus any payment’s processing fee.

You will be responsible for any cancellation charges on flights, accommodation and any other costs You have incurred with respect of such cancellation.
